Welcome to Elevated Systems. These Terms of Service ("Terms") govern your access to and use of the Elevated Systems platform, website, mobile application, and related services (collectively, the "Service") operated by Elevated Systems LLC ("Elevated Systems," "we," "us," or "our"). By creating an account, subscribing to a plan, or using the Service, you agree to be bound by these Terms.
You must be at least 18 years old and authorized to enter contracts on behalf of your business to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.
The Service is offered under three subscription tiers: Access, Elevate, and Command. Each plan includes the features and limits described on our pricing page.
Billing cycle & currency. Subscriptions are billed monthly in advance in U.S. Dollars (USD). The billing cycle begins on the date your subscription is first charged and renews on the same calendar day each month thereafter.
Automatic renewal. Your subscription renews automatically each month at the then-current rate until you cancel. By providing a payment method, you authorize us to charge that payment method for each recurring monthly fee on the renewal date without further action on your part.
How to cancel. You may cancel your subscription at any time from your account dashboard or by emailing [email protected] from the email address on your account. Cancellation takes effect at the end of your current billing cycle — you will continue to have access through the end of the cycle, and you will not be charged for the following month.
Setup deposit. A one-time, non-refundable setup deposit is required at signup to begin onboarding and is applied as a credit toward your first month of service. See our Refund Policy for full details on what is and isn't refundable.
Payment processing. We use Stripe, a PCI-compliant payment processor, to handle all payments. Card details are entered directly with Stripe — we do not store, see, or have access to your full card number. By submitting payment information, you also agree to Stripe's terms and privacy policy.
Failed payments. If a recurring charge fails, we will attempt to re-charge your payment method and notify you by email. If payment cannot be collected within 7 days, we may suspend access to the Service until the balance is resolved.
You agree not to:
You retain ownership of all candidate data, message templates, and other content you upload to or generate through the Service ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely as necessary to provide the Service. We do not sell Your Content or use it to train third-party AI models.
We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party service interruptions (SMS carriers, email providers, calendar integrations), or force majeure events may cause temporary disruptions.
We reserve the right to modify subscription pricing with at least 30 days' written notice. Price changes will not affect your current billing cycle. If you do not agree to a price change, you may cancel before the new pricing takes effect.
You may cancel your subscription at any time from your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing cycle. We may suspend or terminate your account for material breach of these Terms, non-payment, or unlawful use of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific hiring outcomes, conversion rates, or candidate response rates. Results depend on your inputs, market conditions, and execution.
To the maximum extent permitted by law, Elevated Systems' total aggregate liability arising from or related to the Service shall not exceed the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost candidates.
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved through binding arbitration in Mobile County, Alabama, except where prohibited by law.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.

This Privacy Policy explains how Elevated Systems collects, uses, stores, and protects information when you use our Service. We take your data and your candidates' data seriously.
Account Information: Name, business name, email address, phone number, billing address, and payment information (processed via our PCI-compliant payment provider — we do not store full card numbers).
Candidate Data You Upload: Names, contact information, application history, interview status, and any other recruiting data you import or enter.
Usage Data: Log files, IP addresses, browser type, device information, pages visited, and actions taken within the Service.
Communications: Messages and emails sent through the Service, support tickets, and call recordings (where applicable and disclosed).
We use trusted third-party providers to operate the Service:

We retain your account data for as long as your subscription is active. After cancellation, we retain data for 90 days to allow account reactivation, then permanently delete it unless we are required to retain it for legal, tax, or audit purposes. You may request earlier deletion at any time.

We implement industry-standard safeguards including encryption in transit (TLS 1.2+), encryption at rest, access controls, and regular security reviews. No system is 100% secure, however, and we cannot guarantee absolute security. Report suspected vulnerabilities to [email protected].
The Service is intended for business users. We do not knowingly collect personal information from individuals under 18. If you believe a minor has provided us with information, contact us immediately for removal.
We use essential cookies to operate the Service (authentication, preferences) and minimal analytics cookies to understand usage patterns. We do not use third-party advertising cookies or cross-site trackers.
The Service is operated from the United States. If you access it from outside the US, your data will be transferred to and processed in the US, which may have different data protection laws than your country.
We may update this Privacy Policy periodically. Material changes will be communicated via email or in-app notice. The "Last updated" date at the top reflects the most recent version.

We want you to be confident in your investment. This policy explains exactly how refunds work at Elevated Systems — no fine print, no surprises.
Each plan requires a one-time setup deposit at signup:
This deposit secures your onboarding slot and covers the labor required to configure your account, build your automations, and integrate your systems. The deposit is non-refundable once onboarding work has begun — typically within 24 hours of payment.
The deposit is applied as a credit toward your first month of service.
Subscriptions auto-renew monthly in U.S. Dollars until canceled. You may cancel your subscription at any time. Upon cancellation:

Service outages: If a verified outage on our end prevents you from using core features for more than 24 consecutive hours, you may request a service credit equal to the affected period.
Billing errors: Duplicate charges, incorrect amounts, or charges after cancellation are refunded in full. Report within 60 days of the charge.
Chargebacks: Please contact us before initiating a chargeback. Most issues are resolved within 48 hours and avoid the friction of disputing through your bank.
